FREQUENTLY ASKED QUESTIONS

Have the proceedings against Errol Wai-Ping been abandoned?

Some women had erroneously heard that the proceedings against Errol Wai-Ping had been dropped. This is not the case. All necessary pleadings have been filed with the Ontario Superior Court of Justice and the case is going forward.

How many women are involved in the law suit filed against Errol Wai Ping?

We have investigated over 375 cases. We have recommended that between 150 and 200 women proceed to a more thorough investigation.

Is the Ajax-Pickering Hospital a defendant in the lawsuit ?

Yes. The Ajax Pickering Hospital has been named as a defendant in this case. We are working with their lawyers. Our position is that the Hospital gave privileges to Errol Wai-Ping without adequately checking into his training and competence, and that the hospital failed to warn patients of his substandard care.

Is Errol Wai Ping still practicing?

No.

On October 12, 2001, the Ajax-Pickering Hospital forced Errol Wai-Ping to give up his privileges to practice at the hospital - effectively preventing him from performing further surgery.

Errol Wai-Ping was found incompetent by the College of Physicians and Surgeons on November 18, 2003 and on March 11, 2004 his license to practice was revoked.

When are individuals likely to receive compensation?

Each case will differ. For those women who have a legitimate case for compensation, we expect the process to take a further 6 to 18 months.

Will I have to testify?

For those women that have a good case, we will be attempting to negotiate a settlement. If settlement attempts fail, then we will be proceeding to a trial. However, in this event, our clients will be rigorously prepared to testify in Court.

Can I get access to medical records myself?

A patient is entitled to examine and obtain a copy of all information in her medical records. Generally, one can expect to pay $50.00 and up, depending on the volume of material and the age of the records. For example, a long hospital stay, or recurring visits might result in a charge of several hundred dollars.
