 $27.5 million settlement

A settlement was reached in the Ontario EEG-Hepatitis B class action lawsuit in late 2001. The Court approved the settlement on February 4, 2002. Settlement funds have now been distributed pursuant Court order by the Court appointed administrator LECG

The settlement with Toronto neurologist Dr. Ronald H. Wilson, who denies any wrongdoing, paid $27.5 million in damages for the approximately 14,000 people affected by the operation of several EEG clinics in Toronto’s east end. Under the settlement patients received a range of financial benefits depending upon individual circumstances.

Background

In the fall of 1997 a $100-million class-action lawsuit was started in the Ontario Superior Court against Toronto neurologist Dr. Ronald H. Wilson and his technologist Nicholas Kyprianou. Together they operated six electroencephalography (EEG) clinics in the Greater Toronto Area. The principle allegation in this law suit is that both Dr. Wilson and Mr. Kyprianou failed to follow proper sterilization procedures and as a result, triggered the largest ever reported outbreak of hepatitis B.

The representative plaintiffs Robert Anderson and Deborah Fischer are represented by a group of law firms.

The class action seeks general and punitive damages for injuries suffered by those patients who actually contracted hepatitis B and also for those patients who had to undergo otherwise unnecessary testing.
